These terms govern your use of Phantasm. Read them. By signing in or submitting a generation, you accept them. If you don't accept them, stop using the service.
1. Eligibility
You must be at least 18 years old to use Phantasm. You confirm this at sign-up via an age gate; we may require additional verification at any time. Accounts found to be operated by minors are terminated without notice and the data deleted.
You must not have been previously terminated from Phantasm for a violation of these terms. Creating a new account under a different name or email after termination is itself a violation.
2. Your account
You are responsible for everything that happens under your account, including the prompts you submit and the assets you generate. Keep your credentials private. Tell us immediately at hello@phantasm.app if you suspect unauthorised access.
3. Licence to your content
You retain ownership of the prompts you submit and the assets we generate for you. You grant Phantasm a worldwide, non-exclusive, royalty-free licence to store, transmit, process, transcode and deliver your content solely to operate the service for you. This licence ends when you delete the asset, with these narrow exceptions:
- Backups and logs may persist for up to 30 days after deletion.
- When we are legally required to retain a copy (for example, an open law-enforcement request or a CSAM referral), we retain only what the requirement compels and only for as long as it compels.
We do not train models on your prompts or your outputs. We do not sell or share your content with advertisers or data brokers. We do not use your content to fine-tune third-party providers' models. If a provider's terms-of-service would let them train on your inputs, we either disable that flag or do not use the provider.
4. Prohibited content
Phantasm enforces the rules below across every prompt, every reference image, every model, and every generated asset. The bar is intent and result, not phrasing — re-wording, obfuscation, foreign-language prompts, leetspeak, or splitting an idea across multiple turns does not change anything. The full enumeration lives at /rules; the headline categories are:
- Real people. No depictions of real individuals — living or deceased, public or private, celebrities, influencers, politicians, historical figures, anyone — in any context. Stylistic references that don't produce a recognisable likeness are fine; recognisable likenesses are not.
- Minors. No sexualised, suggestive, or otherwise inappropriate depictions of anyone under 18, real or fictional. No photorealistic depictions of minors in any context. We apply the same standard to fictional characters that we apply to real-life minors. Blurring, black bars, self-censoring, or stylisation do not make a prohibited image OK.
- Sexual violence and exploitation. No rape, sexual violence, incest, bestiality, or sexual activity depicted as occurring under intoxication, hypnosis, mind control, or other forms of impaired consent.
- Real-world violence. No graphic depictions of human death, brutal violence, gore, or injuries presented for entertainment. No weapons aimed at individuals in a sexual context.
- Self-harm and disordered eating. No content depicting or glorifying cutting, mutilation, suicide, or eating disorders.
- Hate. No content that attacks, dehumanises, or incites violence against people based on race, ethnicity, national origin, religion, disability, sex, gender, gender identity, sexual orientation, age, veteran status, or serious disease. No extremist propaganda.
- Bodily excretions. Urine, faeces, vomit, menstrual fluid, smegma, diaper content — regardless of intended audience.
- Nudification or deepfake tools. Workflows, models, prompts or reference uploads designed to remove clothing from, or impose the likeness of, a specific real individual. This applies even if you assert the subject consented.
- Impersonation and fraud. No falsely labelling generated content as authentic. No impersonating another person, including in a profile picture. No bounties or solicitations for any of the above.
- Illegal activity. No content that promotes the production of illegal substances, regulated weapons, or other unlawful acts.
Sexually explicit generations must carry the AI-generation metadata block (model, prompt, seed) that Phantasm attaches by default. Stripping or forging that metadata before re-sharing is a violation of these terms.
We may refuse, redact, or remove any generation that we judge to fall within the categories above. Context and intent matter; our judgment is final.
5. Prohibited conduct
- Using the service to violate any law that applies to you or to us.
- Harassment, threats, doxing, or coordinated targeting of any person via Phantasm or via assets you generate here.
- Circumventing or attempting to circumvent our moderation, age gate, rate limits, or other safety controls.
- Reverse-engineering, scraping, or running automated tools against the service for purposes other than your own personal use. The JSON API is for the iOS client; rate-limit-evading automation is not allowed.
- Sharing, reselling, or sub-licensing your access. One account, one person.
- Uploading malware, viruses, or content designed to disrupt the service or other users.
- Creating multiple accounts to evade limits, accumulate credits, or circumvent a prior termination.
6. Moderation and enforcement
We run automated prompt and image classifiers before and after every generation. Borderline cases are queued for human review. The action we take scales with severity:
- Refuse. We block the generation and refund the credit. No record beyond the refusal reason is retained.
- Remove and warn. We delete the asset and notify you. Repeat issues escalate.
- Suspend. We freeze access pending review.
- Terminate. We close the account. No new account permitted under any identity.
- Report. For content depicting minors in a sexualised context, we file the required report with the National Center for Missing & Exploited Children (NCMEC) and preserve evidence under the rules that apply to such reports. We do this without notice to the account holder.
Real-people and minors violations are zero-strike: one confirmed incident is enough for permanent termination.
7. Appeals
If you believe a moderation decision was wrong, email appeals@phantasm.app from the email on your account within 30 days, with the generation ID or asset ID and the basis for the appeal. We aim to respond within 10 business days. Zero-strike decisions (real persons, minors, CSAM) are not appealable.
8. Copyright (DMCA / EU equivalents)
If you believe content on Phantasm infringes your copyright, send a notice to legal@phantasm.app that includes:
- Your physical or electronic signature.
- Identification of the work you claim is infringed.
- Identification of the infringing material and where it appears (asset ID or URL).
- Your contact information.
- A good-faith statement that the use is not authorised.
- A statement, under penalty of perjury, that the notice is accurate and you are authorised to act.
We process notices under the U.S. DMCA and equivalent EU mechanisms (Digital Services Act art. 16 notice-and-action). Repeat infringers are terminated. Counter-notices follow the same channel.
9. Payments, credits, refunds
Paid generations consume credits purchased via Polar.sh, our payments provider and Merchant of Record. Polar invoices you and remits VAT; we receive a payout. Failed generations refund the credit automatically. Subscriptions are non-refundable except where EU consumer law requires otherwise — specifically, you may withdraw within 14 days of purchase unless you have already consumed digital content, which begins on first successful generation and which you expressly consent to start by submitting that generation.
10. Service availability
We aim for high availability but make no guarantees. Generation depends on third-party GPU providers (Modal, fal.ai), an LLM provider (xAI), and content-delivery (Cloudflare). When those break, we break. Credits are refunded for failed generations; outages do not refund subscription fees unless the outage is extended and material.
11. Termination
You may stop using Phantasm at any time and request deletion of your account by emailing privacy@phantasm.app. We may suspend or terminate accounts that violate these terms, with notice when reasonable. On termination your licence rights end immediately and your data is deleted within 30 days, subject to the limited retentions in §3.
12. Disclaimer and liability
The service is provided as is and as available. To the maximum extent permitted by law, we disclaim all warranties — merchantability, fitness for a particular purpose, accuracy of outputs, non-infringement of third-party rights, uninterrupted operation. AI models produce plausible-looking text and images; you are responsible for verifying any factual or legal use.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is capped at the greater of (a) the amount you paid Phantasm in the 12 months before the claim arose and (b) €100. Nothing in this section limits liability for death, personal injury, gross negligence, or fraud where such limitation is prohibited by mandatory consumer-protection law.
13. Indemnity
You will defend and hold us harmless against any third-party claim arising from (a) content you generated or distributed via Phantasm, (b) your breach of these terms or the content rules, or (c) your violation of any third-party right — including IP, privacy, and publicity rights — through your use of the service.
14. Governing law and disputes
These terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. EU consumers retain the protection of mandatory provisions of the law of their country of residence.
Disputes are submitted to the competent court of Amsterdam, the Netherlands, unless a mandatory rule of the consumer's country of residence requires otherwise. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
No arbitration clause. No class-action waiver. We don't pretend you signed something you didn't read.
15. Changes
We will notify you in-app and by email at least 14 days before any material change to these terms or the content rules. Continued use of Phantasm after a change becomes effective is acceptance of the new terms.
